Terms of Service

How we work together.

Last updated · 9 May 2026

01 · Agreement

When you engage We Builder ("we", "us") for design or development work, these terms apply by default. We'll send a separate scope letter for each project; that scope letter takes precedence wherever it differs from these terms.

02 · Scope

Each engagement starts with a fixed scope and a fixed price. The scope letter lists deliverables, timeline, and what's explicitly excluded. We don't bill by the hour.

03 · Scope changes & extra features

If you want something added mid-project, we'll quote the addition separately and start that work after written approval. We don't silently absorb new requirements — and we don't pretend small additions are free, since that's how studios go bankrupt and clients end up with bitter freelancers.

04 · Payment

  • Deposit — typically 20% upfront before we start design.
  • Balance — due on launch (when the site goes live or files are handed over).
  • Methods — Khalti, eSewa, bank transfer (Nepal), or PayPal/Wise (overseas).
  • Late — invoices over 30 days late accrue a 2% monthly handling fee.

05 · Refunds & cancellation

  • Before design starts — full refund of deposit.
  • After design starts, before development — 50% of deposit refunded.
  • After development starts — deposit is non-refundable but you keep all delivered work to date.
  • We cancel — if we walk away for reasons unrelated to your conduct, you receive a full refund.

06 · Timelines

We commit to a delivery window, not a delivery date. Most projects ship within their window. If we're going to slip we tell you as soon as we know — usually with a revised plan.

07 · Intellectual property & ownership

  • Final files — once paid in full, you own the design files, code, and content we produced specifically for your project.
  • Our toolkit — we keep the right to reuse our internal tooling, components, and methods on other work.
  • Showcase — we may display the project in our portfolio unless you specifically ask us not to (in writing). NDAs override this default.
  • Third-party assets — fonts, plugins, stock images we recommend remain under their original licences. We pass on what we know; you're responsible for compliance once delivered.

08 · Client responsibilities

To stay on schedule we ask that you:

  • respond to design / content questions within 3 working days.
  • provide content (copy, images) before the agreed-upon deadline.
  • review and sign off on each milestone within 5 working days.

If feedback drags past 14 days, we may pause work and re-quote when you're ready.

09 · Liability

We're a small studio. Our total liability for any single project is capped at the fees you've paid us for that project. We're not liable for indirect or consequential damages (lost profits, brand impact, etc.). This isn't us being slippery — it's a standard cap that lets us take on work without taking on existential risk.

10 · Governing law

These terms are governed by the laws of Nepal. Any dispute will be handled by the courts of Kathmandu. We'd much rather talk it out first — most issues are resolvable over a phone call.
